Our client, who had previously suffered a traumatic injury rendering her unable to walk, was admitted to the defendant’s facility for specialized rehabilitation. While at the defendant’s hospital, she developed a stage 4 pressure ulcer which required multiple debridements.
Mr. Mesrobian jumped headfirst into the case, pouring through thousands of pages of medical records to determine why our client developed a pressure ulcer. Mr. Mesrobian was able to establish that the facility’s nursing staff failed to follow the physician’s orders requiring repositioning every two hours—a critical preventative measure that was skipped for five consecutive nights prior to the discovery of our client’s injury. Throughout the discovery process, Mr. Mesrobian skillfully obtained deposition admissions from the nursing staff that their actions violated the applicable standard of care. This case involved a dozen depositions, and over 25 court appearances over 3 years of litigation.
This significant settlement, which will likely be one of the year’s highest non-wrongful death pressure ulcer settlements in the state, not only provides a deserving client with just compensation for her suffering, but also sends a powerful message about accountability in healthcare.
