Can a passenger recover damages for accident injuries caused by a driver of the same car?
Stephen D. Phillips: Yes, absolutely. He says that before the early 1950s Illinois did not let passengers recover from their own driver, and that plaintiffs’ lawyers lobbied to change the law so injured people could be fully compensated.

Yes, absolutely. The law in Illinois encourages people who were wrongfully injured to recover full and fair compensation for their injuries. Prior to the early 1950s, the law in Illinois was that injured people, passengers, could not recover from the driver of their own vehicle. We plaintiffs lawyers, we lobbied the legislators down in Springfield, Illinois and told them that the purpose of insurance was to allow injured people full and fair compensation for their injuries. And they changed the law in the 1950s that got rid of the inability to file a claim against one’s own driver.
