There are no caps on damages in Illinois nursing home cases. That’s because when the other side, the insurance industry, big business, nursing homes tried to lobby the legislature to limit damages, the plaintiff’s bar, the Illinois Trial Lawyers Association, of which I am the former president, we fought it and we were able to convince the legislature that limiting damages to those most vulnerable was unfair and improper.
