Phillips Law Offices was recently featured on Fox 32 Chicago regarding a serious pedestrian injury case involving a woman struck and run over while crossing the street in a marked crosswalk.
Attorney Steve Phillips identified the victim as Beata Koschielska, who remains hospitalized with multiple broken bones, including fractures to her pelvis, femur, ankle, and arm. Mr. Phillips stated that the firm plans to file a civil lawsuit against the driver responsible for causing her injuries.
According to Chicago police, the incident occurred at the intersection of Belmont and Pulaski. Surveillance video shows Ms. Koschielska walking west across Belmont Avenue while a red Ford pickup truck waited at a traffic light. When the light turned green and the pedestrian walk signal activated, the truck entered the crosswalk, struck her, and ran her over twice.
Bystanders rushed to assist before emergency responders arrived. The video also shows significant snow accumulation on the truck’s hood, roof, and windshield.
Illinois law prohibits drivers from operating a vehicle when snow or ice obstructs their view. Violations of this law can result in citations and may be evidence of negligence in a civil case.
“The fact that there was a camera documenting this is invaluable,” Phillips said. “It clearly showed that this driver didn’t take the time to clear snow or ice from the vehicle.”
Chicago police confirmed that the 39-year-old driver was issued a citation, though specific details have not been released.
